These Terms of Service (“Terms”) govern your access to and use of dewinespot.co, our physical store, and any related services, communications, purchases, pickups, deliveries, or shipments provided by De Wine Spot, Inc. (“De Wine Spot,” “we,” “us,” or “our”), collectively, the “Services.”
By visiting the site, creating an account, placing an order, purchasing a product, or otherwise using the Services, you agree to these Terms and to our policies referenced below. If you do not agree, do not use the Services.
1. Eligibility and Age Requirements
You must be legally capable of entering into a binding agreement to use the Services.
You must be at least 21 years old to purchase, pick up, receive, or take delivery of alcoholic beverages. By placing an order containing alcohol, you represent that you and the intended recipient are at least 21 years old and legally permitted to purchase and receive the products at the destination.
Valid government-issued photo identification and an adult signature may be required for pickup or delivery. We and our delivery partners may refuse or cancel a sale, pickup, or delivery when age or identity cannot be verified, when the recipient appears intoxicated, or when completing the transaction could violate applicable law.
You may not purchase alcoholic beverages for a person under 21 or use the Services to facilitate an unlawful transfer of alcohol.
2. Accounts and Information
You agree to provide current, complete, and accurate account, billing, shipping, payment, and contact information.
You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly at support@dewinespot.co if you suspect unauthorized access or use.
We may suspend or terminate an account that contains inaccurate information, is used unlawfully, creates risk for us or others, or violates these Terms.
3. Products, Descriptions, and Availability
We make reasonable efforts to describe and display products accurately. Product images are illustrative, and packaging, labels, bottle designs, gift boxes, vintages, proof statements, fill levels, wax, closures, and other details may vary unless a specific version is expressly guaranteed in the product description.
Wine and spirits may show natural variation. Sediment, color variation, bottle variation, cosmetic label wear, or similar characteristics do not necessarily mean a product is defective.
All products are subject to availability. Limited, allocated, vintage, special-order, and independently sourced products may become unavailable without notice. We may limit quantities, restrict sales, substitute an expressly approved comparable item, or discontinue any product at any time.
Unless we approve otherwise in writing, products purchased through the Services are intended for personal use and not for unauthorized resale or export.
4. Prices, Taxes, and Payment
Prices, promotions, discounts, shipping charges, and availability may change without notice before an order is accepted.
Prices displayed on the site generally exclude applicable taxes, shipping, delivery, adult-signature, customs, duties, brokerage, insurance, and other charges unless expressly stated otherwise. Applicable amounts are calculated or disclosed during checkout when available.
You authorize us and our payment providers to charge the payment method submitted for the order total and any additional amount you expressly approve.
We may correct pricing, description, discount, inventory, or calculation errors and may cancel or revise an affected order before fulfillment. If we cancel an order after payment, we will issue the appropriate refund.
5. Orders and Acceptance
Your submission of an order is an offer to purchase. An order confirmation means that we received the order; it does not mean that we accepted it.
We may review, accept, reject, limit, hold, or cancel an order for reasons including inventory availability, pricing or listing errors, suspected fraud, payment issues, legal restrictions, shipping limitations, age-verification concerns, quantity limits, or misuse of a promotion.
An order is accepted when we begin fulfillment, make it available for pickup, or otherwise confirm acceptance. We may require additional verification before accepting or fulfilling an order.
Order-cancellation requests are not guaranteed. Once an order has entered processing, packing, fulfillment, or shipment, it normally cannot be canceled. Additional details appear in our Refund Policy.
6. Alcohol Sales, Pickup, Delivery, and Shipping
Alcoholic beverages are sold only where and in the manner we determine is legally and operationally permissible.
The person receiving an alcohol order must be at least 21 years old and may be required to show valid government-issued photo identification. Alcohol shipments cannot be left unattended.
Availability of store pickup, local delivery, nationwide shipping, international shipping, carriers, rates, and delivery estimates varies by order and destination.
Delivery dates and transit times are estimates, not guarantees. Delays can occur because of weather, carrier operations, holidays, customs, address issues, security reviews, inventory availability, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address and for ensuring that an eligible adult is available to accept the shipment.

7. Returns, Refunds, Damage, and Incorrect Items
Due to the nature of alcoholic beverages, sales are generally final except as stated in our Refund Policy or required by applicable law.
Shipping damage and incorrect items must be reported within 48 hours of delivery, together with the information and photographs described in the Refund Policy.

8. Promotions, Discounts, and Store Credit
Promotions, discount codes, free-shipping offers, loyalty benefits, memberships, and store credits are subject to their stated terms, availability, eligibility rules, and expiration dates.
Unless expressly stated otherwise, promotional offers cannot be combined, have no cash value, cannot be applied retroactively, and may be limited or withdrawn when used improperly, obtained through error, or affected by fraud.
We may cancel orders or reverse benefits resulting from unauthorized, duplicate, automated, or abusive use of a promotion.
9. Ownership and Permitted Use
The Services and their content—including text, graphics, photographs, logos, designs, product descriptions, videos, software, and arrangement—are owned by or licensed to De Wine Spot and are protected by intellectual-property laws.

15. Errors and Service Changes
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product details, prices, promotions, availability, shipping, or other matters.
We may correct errors, update information, modify or discontinue features, and cancel affected orders at any time, subject to applicable law.

17. Limitation of Liability
To the fullest extent permitted by law, De Wine Spot and its owners, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Services or these Terms.
To the fullest extent permitted by law, our aggregate liability for a claim relating to a product, order, or transaction will not exceed the amount you paid for the product, order, or transaction giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited, or to liability arising from fraud, willful misconduct, or gross negligence where applicable law prohibits limitation.

20. Governing Law and Disputes
These Terms and any dispute arising from them are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent mandatory law in your jurisdiction applies.
Subject to any non-waivable consumer right, legal proceeding relating to these Terms or the Services must be brought in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction.
Before filing a claim, you agree to contact us at support@dewinespot.co and make a good-faith effort to resolve the dispute informally.
21. Changes to These Terms
We may update these Terms to reflect changes in the Services, business practices, technology, or law. The revised Terms become effective when posted unless a later date is stated.
Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms.
22. General Provisions
If any provision of these Terms is held unenforceable, the remaining provisions remain effective, and the unenforceable provision will be enforced to the maximum extent permitted by law.
Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or similar transaction.
These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any additional terms presented for a specific product, promotion, membership, or service, constitute the agreement between you and De Wine Spot regarding the Services.
